TERMS OF SERVICE & BUSINESS CONDITIONS

OVERVIEW

This website is operated by MICHAEL MODER TRADE LIMITED, Ireland (Registration No. 698039). Throughout the site, the terms “we”, “us” and “our” refer to Michael Moder Trade Limited.

By visiting our site and/or purchasing from us, you agree to be bound by the following terms and conditions. These Terms of Service apply to all users of the site. Our store is hosted on Shopify Inc.

SECTION 1 - OPERATOR AND LOGISTICS

The operator of this website and the sole exporter of goods is: MICHAEL MODER TRADE LIMITED 51 Bracken Road, Sandyford, Dublin 18, D18 CV48, Ireland.

  • Warehouse: All orders are processed and dispatched exclusively from our warehouse in Ireland.

  • Dispatch Time: We aim to dispatch orders usually by the next business day after payment confirmation.

  • Registered Office: Please note that our office address in Sandyford is for legal purposes only. No stock is kept there, and no customer visits or unauthorized returns are accepted at this location.

SECTION 2 - PRODUCTS, HYGIENE, AND RETURNS (STRICT)

Due to the nature of our products (cosmetics, personal care, and dietary supplements), strict health and hygiene rules apply:

  • Hygiene Clause: Pursuant to Article 16(e) of the EU Consumer Rights Directive (2011/83/EU), the right of withdrawal does not apply to sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.

  • Final Sale: Once the original factory seal is broken or the packaging is opened, the item is non-returnable and non-refundable.

  • Eligible Returns: Only unopened, factory-sealed items may be considered for return within 14 days of receipt. The buyer is responsible for all return shipping costs.

SECTION 3 - INTERNATIONAL SHIPPING & CUSTOMS (UK, USA, WORLDWIDE)

For orders delivered outside the European Union:

    • Customs & Duties: All import duties, VAT, or taxes imposed by the destination country are the sole responsibility of the buyer.

    • USA Orders: As of 2026, all shipments to the USA are subject to mandatory duties. Failure to cooperate with U.S. Customs results in forfeiture of the shipment.

    • UK Orders: Shipping to the United Kingdom is available with a flat-rate fee of €20.00. There is no minimum order limit, but individual orders are strictly limited to a maximum value of €130.00, managed automatically by our system. Orders exceeding £135 remain subject to local UK taxes and duties as per local legislation.

SECTION 4 - UNCOLLECTED AND REFUSED SHIPMENTS

  • SHIPPING AND HANDLING FEES – DETAILED BREAKDOWN AND POLICY

Please note that all delivery charges presented at checkout are strictly defined as combined "Shipping and Handling" fees. These flat rates are determined, calculated, and set exclusively by MICHAEL MODER TRADE LIMITED.

By completing your purchase, you explicitly acknowledge and agree that the "Shipping and Handling" fee you pay is not limited merely to the postage tariff charged by the international carrier (e.g., An Post). The "Handling" portion of this fee specifically covers extensive operational and service costs provided by our company, which include, but are not limited to:

  • Premium packaging materials and protective filling to ensure product safety.

  • Labor costs associated with the physical picking, packing, and dispatch operations.

  • Administrative processing, including the generation of international customs declarations and tracking documentation.

  • Proactive customer service communication, including personalized emails regarding delivery verification and tracking assistance.

  • Administrative time spent monitoring international postal networks and providing support for successful delivery collection.

Because a significant portion of this fee covers our immediate operational labor, customer support services, and consumed packaging materials prior to dispatch, you explicitly understand and agree that our flat-rate Shipping and Handling charges are absolutely final and non-negotiable. As dictated by our Zero Refund Policy, these combined Shipping and Handling fees are strictly non-refundable under any circumstances in the event of an uncollected, ignored, or returned international parcel.

  • CUSTOMER TRACKING OBLIGATIONS AND INTERNATIONAL POSTAL HANDOVER

Upon dispatch from our Irish facility, all international shipments are handed over to An Post (the Irish national postal service). Please be explicitly aware that An Post’s online tracking system often only provides detailed status updates until the parcel officially leaves the Republic of Ireland.

Once the package crosses the border and enters your destination country, it is completely transferred into the physical jurisdiction and data network of your local national postal carrier (e.g., Cyprus Post, USPS, Royal Mail, Correos, etc.). From this exact moment, our company has absolutely no control over the delivery timeline, local sorting office procedures, or the notification practices of your local postal carrier.

Therefore, it is your strict, mandatory, and sole responsibility as the buyer to take the provided international tracking number and actively monitor your shipment's progress directly on the official tracking website of your own country's national postal service. You must not rely solely on the initial An Post tracking link.

Many local postal networks worldwide no longer leave physical delivery notices (paper cards) at your residential address if you are unavailable at the time of the delivery attempt. If you fail to actively track your package online via your local carrier's website, miss a delivery attempt, or fail to collect the parcel from your designated local collection point within their specified holding timeframe, the package will automatically be returned to us in Ireland. As previously stated, in the event of such an uncollected or ignored shipment, the combined Shipping and Handling fees are strictly non-refundable.

  • Zero Refund Policy: We strictly do not issue refunds for shipments that are uncollected, ignored by the buyer, or refused by the recipient or customs.

  • Forfeiture: If a parcel is returned to our warehouse due to the buyer's failure to collect it, all funds paid (product price and shipping) are forfeited. We do not offer free reshipping.

SECTION 5 - DAMAGES AND CLAIMS

  • Protocol: Any claim for transit damage requires clear photo documentation of the shipping box before opening.

  • Carrier Confirmation: No replacements or refunds will be processed until the shipping carrier officially admits fault and confirms the damage in writing.

SECTION 6 - ACCURACY OF BILLING AND PRICES

Prices are subject to change without notice. We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person or per order.

SECTION 7 - GOVERNING LAW

These Terms of Service and any separate agreements shall be governed by and construed in accordance with the laws of Ireland. Any disputes shall be subject to the exclusive jurisdiction of the Irish courts.

FINAL PROVISION - ACCEPTANCE OF TERMS

By completing the checkout process and submitting an order on drnona.shop, the buyer explicitly acknowledges that they have read, understood, and agree to be bound by these Terms of Service, including our Shipping and Return Policies. This agreement constitutes a legally binding contract between the buyer and MICHAEL MODER TRADE LIMITED.
